Terms & Conditions for Mulberry Loft, St Ives

Agreement

For the attention of the hirer.

Reference to the ‘the hirer’ means the person or persons accepted by the owner as authorised to occupy the Property for the period specified on the Booking Form. The hirer will be responsible for the entire booking and its associated cost and upon signing/accepting the booking, accepts this agreement, including on behalf of all the parties members.  Once the booking is accepted by the owner, the hirer is responsible for full payment when due.

If booking through an agreed online agent such as Airbnb or Owners Direct the hirer has agreed to their booking terms such as deposits, payments, data protection and cancellations in addition to agreeing to these terms and conditions.

If booking direct with the owner or via the Mulberry Loft website (mulberryloft.co.uk), a non-refundable deposit of 25% of the full tariff is payable at the time of booking (the “deposit”). The balance of the tariff must be paid at least six weeks before the start date. If your holiday begins less than six weeks from the time of booking, the full tariff is payable on booking.

Again a refundable damage deposit of £100 shall be payable at our discretion (the “Refundable Damage Deposit”) if you are booking via Mulberry Loft website, otherwise it will as agreed by the online booking agent. 

We have made all reasonable efforts to accurately describe Mulberry Loft and cannot accept responsibility for errors contained in the information and the hirer acknowledges that minor differences may arise between the information given and the actual property itself.

Payment for hirer’s using www.mulberryloft.co.uk only

For bookings made within 2 months of your holiday start date, please pay the full amount plus damage deposit. For a booking made more than 2 months before your holiday start date, please provide a deposit of 25% of the rental cost. The balance plus the damage deposit is then due 2 months prior to the holiday start date.  Charges for any third party payment mechanisms such as PayPal are the responsibility of the hirer.

Changing Bookings for hirer’s using www.mulberryloft.co.uk only

If the hirer wishes to change the booking, then subject to availability we will move the booking at a charge of £30 and either request immediate payment of the outstanding balances or refund any outstanding balance against the published rates in accordance with the rest of this agreement.

Damage Deposit

All bookings are accepted on the condition that the property is left clean and tidy and all breakages or the person who made the booking will pay for any damage. A damage deposit of £100 is charged and held by us and will be returned in full normally within 21 days after departure, provided no loss or damage has been incurred and the property is left in a clean and tidy condition. We reserve the right to withhold part or all of the deposit towards cleaning costs, where the property has not been left in good condition. The property is checked on departure and any damage to the equipment or the property is fully chargeable to the hirer. The liability is not limited to the deposit.

Availability

This Agreement is made on the understanding that the property will be available for the dates stated. In the unlikely event that the property is not available through events arising out of our control then we may be forced to cancel the booking. The hirer will be advised of such circumstances as early as possible and we will refund all monies paid in full but the hirer and we will not be under any further liability towards the hirer.

In the event of a cancellation being received and confirmed in writing from the hirer, we will endeavor to re-let the property and, if successful, we will refund the monies already paid less administration cost of £50. If the property is not re-let for any reason, the original hirer is liable for the whole of the rental amount.  This term may vary with the direct booking site, therefore please refer to their terms.

Data and Privacy 

In making a booking we will ask for personal information such as your name, postal address, email address, telephone number and payment details. We may use the data to inform you about news and information we think may be of interest to you if you elect to do so. We will not pass your information onto any third parties.  Please refer to the online agents terms and conditions, which may also apply.

Liability

We do not accept any liability for any accident, damage, loss, injury, or expense, whether to persons or to property, which the hirer or any other persons may suffer or incur arising out of, or in any way connected to the letting.

The hirer shall not be entitled to any assured shorthold or assured tenancy or any statutory protection under the House Act 1988 or other security of tenure now or on determination of this hire. This agreement confers upon the right to occupy the Property for a holiday.

Linen and towels

The property is equipped with bed linen including sheets, duvets, duvet covers and pillowcases. We also provide towels and tea towels.

Gas and Electricity

The rental cost is inclusive of all gas and electricity.

Sleeping Capacity

Persons other than those named on the booking form may not occupy the property. The hirer shall not part with possession of the property or share it except with members of the party named on the booking form.

Neighbours

The hirer and other members of the party must not cause an annoyance or become a nuisance to occupants of the neighbouring properties.

Health and Safety

It is important the hirer becomes familiar with the safety features in the property, which includes a fire ladder (located in the master bedroom).  It is requested that adults supervise children to not tamper with any of the safety equipment, including the babygate.

Wifi

We provide reasonable and free usage of wifi for use when the hirer is using the property.

Keys

We provide one set of keys (in the key safe) and another spare set of keys in the property.  It is important that hirers keep keys safe at all times and we recommend a spare set of keys are secured in the outside safe.  Hirers who misplace or lock themselves out of the property are responsible for all costs relating to re-access and making good of any locks and supply of spare keys.

Occupation Times

Tenancies commence after 3pm on the start date of your holiday and terminate at 10am on the finish date of your holiday. Under no circumstances may the hirer enter the property before 3pm on the commencement date and the property must be vacated by 10am on the termination date.

Vacating the property

Hirers are responsible for the upkeep of the property as would be expected for a self-catering holiday stay.  The property is professionally cleaned ready for hirer’s stays and if there are any issues, the hirer must report these as soon as possible on the day of access.    The owner keeps a spare set of wine and water glasses in the property and ask that any breakages be reported to allow for replenishment for the next hirer.  Any other breakages or damage must be reported immediately and may be charged out of the damage deposit.

Access

The Property our representatives or we shall be allowed access to the property at any reasonable time during the holiday occupancy.

Pets and Smoking

The Property does not accept pets and is strictly non-smoking.

Personal belongings

Baggage and personal belongings are at the hirer’s risk and no responsibility can be accepted for loss of or damage to such items.

Insurance

We recommend that the hirer take out insurance to cover the cost of events such as losses, damage to personal belongings and cancellation.
